What happens if the trademark expires?
After the 6-month grace period ends, the mark lapses. IP India may then advertise the mark as lapsed and the mark reverts to the public domain — anyone can file a fresh application for the same mark.
Can I use ® after the renewal filing?
Yes. The mark remains registered during the renewal process. You may continue using ® throughout.
What if the registered owner has changed since registration?
If ownership has changed through assignment, succession or merger since registration, the new owner must be recorded at IP India before renewal. SS Marks handles the recordal of assignment alongside the renewal where required.
Can I renew for fewer classes than originally registered?
Yes. You can choose to renew only in some of the registered classes — for example, if you are no longer active in certain goods or services categories.
