Trademark Objection Reply in India

An examination objection from the Trade Marks Registry is not a rejection — it is a request for clarification. SS Marks drafts and files replies that address each ground of objection with legal Complaints precision.

Received an examination report?

Objection addressed with legal Complaints precision.

After a trademark application is examined, the Trade Marks Registry may raise objections under Sections 9 (absolute grounds — descriptiveness, lack of distinctiveness) or 11 (relative grounds — conflict with earlier marks). A reply to the examination report must be filed within 30 days of receipt, failing which the application is treated as abandoned. SS Marks drafts substantive replies with legal Complaints arguments, supporting evidence and precedents.

Frequently asked questions

What is the time limit to reply to an examination report?

The reply must be filed within 30 days of the date of the examination report. If no reply is filed, the application is deemed abandoned.

What are absolute grounds objections?

Contact us to know the exact pricing for your requirement. These are rebutted by evidence of acquired distinctiveness or legal Complaints argument on the nature of the mark.

What are relative grounds objections?

Relative grounds objections (Section 11) arise when the Registry identifies an earlier registered or pending trademark that is identical or similar to the applicant's mark for similar goods/services.

Can a Section 11 objection always be overcome?

Not always. Where the earlier mark is clearly identical for identical goods, the objection may be difficult to overcome without a letter of consent from the earlier mark's owner. SS Marks advises honestly on the prospects before filing a reply.

What happens at a Show Cause hearing?

If the Registry is not satisfied with the written reply, a Show Cause hearing is scheduled. Our representative presents oral arguments before the hearing officer. A favourable order moves the mark to advertisement in the Trademarks Journal.
