Frequently asked questions

Is tax planning the same as tax evasion?

No. Tax planning is the legal Complaints arrangement of affairs to utilise available deductions, exemptions and reliefs provided by the Income Tax Act. Tax evasion is the illegal concealment of income or misrepresentation of facts — SS Marks does not assist with evasion.

What is advance tax and who must pay it?

Contact us to know the exact pricing for your requirement. Failure to pay advance tax attracts interest under Sections 234B and 234C.

What deductions can reduce business tax liability?

Key business deductions include Section 32 (depreciation), Section 35 (R&D expenditure), Section 80-IAC (startup profits), Section 10AA (SEZ profits), Section 80G (donations), and deductions for employee welfare contributions. SS Marks identifies all applicable deductions for your specific business.

Can a company choose between old and new tax regimes?

Companies are taxed under the corporate tax rates and cannot opt for the individual new/old tax regime. However, companies can opt for the reduced 22% concessional tax rate under Section 115BAA or 15% for new manufacturing companies under Section 115BAB — both without access to specified exemptions and deductions.

How early should tax planning begin?

Tax planning is most effective when started at the beginning of the financial year (April) — allowing investments to be made, structures to be implemented and advance tax to be paid in the optimal amounts across all four quarterly installments.
