Protecting an invention?

Invention protected with a 20-year monopoly.

A patent in India is granted by the Indian Patent Office (IPO) for inventions that are novel, involve an inventive step and are capable of industrial application. The application can be filed as a provisional specification (to secure a priority date) or as a complete specification. A Request for Examination must be filed within 48 months of the priority date. SS Marks advises on patentability, drafts the claims and specification, and manages the prosecution through to grant.

Documents required

  • Detailed description of the invention (how it works, what problem it solves, what makes it novel)
  • Prior art search results if available
  • Drawings or diagrams (if applicable to the invention)
  • Identity proof and address of the inventor(s) and applicant
  • Assignment of invention from inventor to applicant (if different from inventor)
  • Priority document (if claiming Paris Convention priority from an earlier foreign application)

Frequently asked questions

What is the difference between a provisional and a complete specification?

A provisional specification secures a priority date without disclosing all details — useful when the invention is still being developed. A complete specification with full claims must be filed within 12 months of the provisional.
